Free Nicotine Pouches in the UK: What’s Changing?

Free nicotine pouch promotions have previously been used by some brands and retailers to allow adult nicotine users to try a product without paying the usual retail price. However, the rules surrounding these promotions are changing.

From 29 October 2026, it will be an offence to give away a nicotine product or coupon to a member of the public where the purpose or effect is to promote a nicotine product. Government guidance specifically states that businesses must not offer free samples or promotional product giveaways, whether in-store, online or through third-party promotions.

The new rules also cover products and coupons offered at a substantial promotional discount where the purpose or effect is to promote a nicotine product. This does not amount to a ban on ordinary discounts: government guidance says normal discounting practices can continue, while the circumstances and scale of a discount determine whether it is considered substantial.

The new rules do not prohibit all discounting. Government guidance states that normal discounting practices can continue, including ordinary reductions to clear unsold stock. Bulk and trade discounts may also continue where applicable.

What About Multi-Buy Offers?

Multi-buy pricing is not automatically prohibited simply because buying several products reduces the price per item. However, whether a particular promotion falls within the new rules depends on its nature, the level of discount and whether its purpose or effect is to promote a nicotine product.

For that reason, the legislation shouldn't be interpreted as either a blanket ban on multi-buy offers or blanket permission for every type of discounted promotion.

What Does This Mean for Customers?

The change does not make nicotine pouches illegal or prevent adults from buying them in the UK. It specifically changes how nicotine products can be given away and promoted.

From 29 October 2026, customers should no longer expect retailers or brands to offer promotional free nicotine pouch samples or giveaways. At the same time, a legal minimum age of 18 will apply to the sale of nicotine pouches and other nicotine products.

Normal retail sales can continue, and the new rules do not create a general ban on ordinary discounts. However, substantial promotional discounts can also fall within the restrictions where their purpose or effect is to promote a nicotine product.
